Enforcement Decree of the Act on the Protection, Use, etc. of Location Information, Article 37-3 (Processing of Personally Identifiable Information)
①방송미디어통신위원회(법 제38조에 따라 방송미디어통신위원회의 권한을 위임받거나 업무를 위탁받은 자를 포함한다)는 다음 각 호의 사무를 수행하기 위하여 불가피한 경우 「개인정보 보호법 시행령」 제19조제1호 또는 제4호에 따른 주민등록번호 또는 외국인등록번호가 포함된 자료를 처리할 수 있다. <개정 2014.8.6, 2015.8.3, 2018.10.16, 2022.4.19, 2025.10.1>
(1) Where unavoidable for carrying out the following affairs, the Media and Communications Commission (including a person delegated authority or entrusted with work of the Media and Communications Commission under Article 38 of the Act) may process data that includes resident registration numbers or alien registration numbers under Article 19, subparagraph 1 or 4 of the Enforcement Decree of the Personal Information Protection Act:
1. 법 제5조에 따른 개인위치정보사업의 등록, 변경등록 및 변경신고에 관한 사무
1. Affairs concerning registration, change of registration, and report of change of personal location information businesses under Article 5 of the Act;
1의2. 법 제5조의2에 따른 사물위치정보사업의 신고 및 변경신고에 관한 사무
1-2. Affairs concerning reports and reports of change of object location information businesses under Article 5-2 of the Act;
2. 법 제6조에 따른 임원의 결격사유 확인에 관한 사무
2. Affairs concerning verification of grounds for disqualification of officers under Article 6 of the Act;
3. 법 제7조에 따른 위치정보사업의 양수 및 법인의 합병 등의 인가 또는 신고에 관한 사무
3. Affairs concerning authorization or reporting of acquisition of location information businesses and mergers of corporations, etc. under Article 7 of the Act;
4. 법 제8조에 따른 위치정보사업 휴업ㆍ폐업의 승인 또는 신고에 관한 사무
4. Affairs concerning approval or reporting of suspension or closure of location information businesses under Article 8 of the Act;
5. 법 제9조에 따른 위치기반서비스사업의 신고 및 변경신고에 관한 사무
5. Affairs concerning reports and reports of change of location-based service businesses under Article 9 of the Act;
5의2. 법 제9조의2에 따른 소상공인등의 위치기반서비스사업의 신고 및 변경신고에 관한 사무
5-2. Affairs concerning reports and reports of change of location-based service businesses by small business owners, etc. under Article 9-2 of the Act;
6. 법 제10조에 따른 위치기반서비스사업의 양수 및 법인의 합병 등에 대한 신고에 관한 사무
6. Affairs concerning reports of acquisition of location-based service businesses and mergers of corporations, etc. under Article 10 of the Act;
7. 법 제11조에 따른 위치기반서비스사업의 휴업ㆍ폐업의 신고에 관한 사무
7. Affairs concerning reports of suspension or closure of location-based service businesses under Article 11 of the Act;
8. 법 제13조에 따른 등록 취소, 사업 정지 등에 관한 사무
8. Affairs concerning revocation of registration, suspension of business, etc. under Article 13 of the Act;
9. 법 제14조에 따른 과징금 부과ㆍ징수에 관한 사무
9. Affairs concerning the imposition and collection of penalty surcharges under Article 14 of the Act;
10. 법 제16조제3항에 따른 점검에 관한 사무
10. Affairs concerning inspection under Article 16 (3) of the Act;
11. 제17조에 따른 과징금의 납부기한 연장 및 분할납부에 관한 사무
11. Affairs concerning extension of the payment deadline and payment in installments of penalty surcharges under Article 17;
12. 법 제36조에 따른 자료제출 요구 및 검사에 관한 사무
12. Affairs concerning requests for submission of materials and inspections under Article 36 of the Act.
② 긴급구조기관 또는 경찰관서는 법 제29조에 따른 긴급구조를 위한 개인위치정보의 이용에 관한 사무를 수행하기 위하여 불가피한 경우 「개인정보 보호법 시행령」 제19조제1호 또는 제4호에 따른 주민등록번호 또는 외국인등록번호가 포함된 자료를 처리할 수 있다. <신설 2014.8.6>
(2) Where unavoidable for carrying out affairs concerning the use of personal location information for emergency rescue under Article 29 of the Act, an emergency rescue agency or police agency may process data that includes resident registration numbers or alien registration numbers under Article 19, subparagraph 1 or 4 of the Enforcement Decree of the Personal Information Protection Act.
