초ㆍ중등교육법 시행령 제31조의5(학생의 정서ㆍ행동 지원을 위한 상담 권고 등)

① 학교의 장은 법 제18조의5제1항에 따라 다음 각 호의 어느 하나에 해당하는 경우 학생과 보호자에게 상담을 받도록 권고할 수 있다.

(1) Pursuant퍼수언트 to투 Article아터클 18-5 (1) of어^v브 the^ð디 Act,액트 the^ð더 head헤드 of어^v브 a어 school스쿨 may메이 recommend^r레커멘드 that^ð댓 a어 student스투던트 and앤드 the^ð더 student's스투던츠 guardian가디언 receive^r러시^v브 counseling카운설링 in인 any에니 of어^v브 the^ð더 following^f팔로잉 cases:케이시즈

② 학교의 장은 법 제18조의5제1항에 따라 학생과 보호자에게 상담을 받도록 권고하려면 다음 각 호의 어느 하나에 해당하는 정신건강 등 관련 전문가(해당 학생이 소속된 학교에 소속되지 않은 사람으로 한정하며, 이하 이 조 및 제31조의6에서 "전문가"라 한다)의 의견을 청취하고, 학생의 정서ㆍ행동 지원을 수행하기 위한 학교 내 관련 위원회의 심의를 거쳐야 한다. 다만, 학교의 장은 상담을 권고받은 학생과 보호자가 정당한 사유 없이 상담을 받지 않아 같은 사유로 반복하여 상담을 받도록 권고하는 경우에는 전문가의 의견 청취 및 위원회의 심의를 생략할 수 있다.

③ 학교의 장은 제2항에 따른 위원회의 심의 결과에 따라 학생과 보호자에게 상담을 권고하는 경우에는 해당 학생과 보호자가 지체 없이 전문가의 상담을 받을 수 있는 방법 등을 보호자에게 안내해야 한다.

④ 학교의 장은 법 제18조의5제2항에 따라 학생의 정서ㆍ행동 지원을 수행하기 위한 학교 내 관련 위원회의 심의를 거쳐 같은 조 제1항에 따른 상담 결과를 반영한 다음 각 호의 지원을 할 수 있다.

⑤ 제1항부터 제4항까지에서 규정한 사항 외에 상담 권고 및 치료 권고ㆍ지원에 필요한 세부적인 사항은 교육감이 정한다.
