국토의 계획 및 이용에 관한 법률 시행령 제36조(공동구의 설치에 대한 의견 청취)

① 법 제44조제1항에 따른 개발사업의 시행자(이하 이 조, 제37조, 제38조 및 제39조의2에서"사업시행자"라 한다)는 공동구를 설치하기 전에 다음 각 호의 사항을 정하여 공동구에 수용되어야 할 시설을 설치하기 위하여 공동구를 점용하려는 자(이하 "공동구 점용예정자"라 한다)에게 미리 통지하여야 한다.

② 제1항에 따라 공동구의 설치에 관한 통지를 받은 공동구 점용예정자는 사업시행자가 정한 기한까지 해당 시설을 개별적으로 매설할 때 필요한 비용 등을 포함한 의견서를 제출하여야 한다.

③ 사업시행자가 제2항에 따른 의견서를 받은 때에는 공동구의 설치계획 등에 대하여 공동구협의회의 심의를 거쳐 그 결과를 법 제44조제1항에 따른 개발사업의 실시계획인가(실시계획승인, 사업시행인가 및 지구계획승인을 포함한다. 이하 제38조제3항에서 "개발사업의 실시계획인가등"이라 한다) 신청서에 반영하여야 한다.
