근로기준법 시행령 제59조(권한의 위임)
Enforcement Decree of the Labor Standards Act, Article 59 (Delegation of Authority)
법 제106조에 따라 고용노동부장관은 다음 각 호의 사항에 관한 권한을 지방고용노동관서의 장에게 위임한다. <개정 2010.7.12, 2019.7.2, 2021.3.30, 2025.4.8>
Under Article 106 of the Act, the Minister of Employment and Labor delegates authority over the following matters to the heads of regional employment and labor offices:
1. 법 제13조에 따른 보고 또는 출석의 요구
1. Requests to report or appear under Article 13 of the Act;
2. 법 제24조제4항에 따른 해고계획 신고의 수리
2. Acceptance of reports of dismissal plans under Article 24 (4) of the Act;
2의2. 법 제43조의4제1항 각 호에 해당하는지 여부에 관한 확인
2-2. Confirmation of whether a person falls under any subparagraph of Article 43-4 (1) of the Act;
2의3. 법 제43조의6제2항에 따른 정보 제공
2-3. Provision of information under Article 43-6 (2) of the Act;
2의4. 법 제43조의7 및 이 영 제23조의11에 따른 출국금지 해제 사유 발생 사실의 확인
2-4. Confirmation of the fact that a reason for lifting a prohibition of departure has arisen under Article 43-7 of the Act and Article 23-11 of this Decree;
2의5. 법 제51조의2제5항 본문에 따른 임금보전방안 신고의 수리
2-5. Acceptance of reports of measures to compensate for wages under the main text of Article 51-2 (5) of the Act;
3. 법 제53조제4항에 따른 근로시간 연장의 인가 또는 승인
3. Authorization or approval of extensions of working hours under Article 53 (4) of the Act;
4. 법 제53조제5항에 따른 휴게 또는 휴일의 명령
4. Orders to give break time or holidays under Article 53 (5) of the Act;
5. 법 제63조제3호에 따른 감시 또는 단속적으로 근로에 종사하는 자에 대한 승인
5. Approval for persons engaged in surveillance work or intermittent work under Article 63, subparagraph 3 of the Act;
6. 법 제64조에 따른 취직인허증의 발급 또는 취직인허의 취소
6. Issuance of employment permits or revocation of employment permission under Article 64 of the Act;
7. 법 제67조제2항에 따른 미성년자에게 불리한 근로계약의 해지
7. Termination of employment contracts unfavorable to minors under Article 67 (2) of the Act;
8. 법 제70조제2항 단서에 따른 임산부와 18세 미만인 자의 야간근로 또는 휴일근로의 인가
8. Authorization of night work or holiday work by pregnant or postpartum women and persons under 18 under the proviso to Article 70 (2) of the Act;
9. 법 제88조에 따른 재해의 인정 등의 이의에 대한 심사ㆍ중재 및 이를 위한 진단이나 검안에 관한 사항
9. Review and arbitration of objections concerning the recognition of accidents and similar matters under Article 88 of the Act, and matters concerning diagnoses or examinations for that purpose;
10. 법 제93조에 따른 취업규칙 신고의 수리
10. Acceptance of reports of rules of employment under Article 93 of the Act;
11. 법 제96조제2항에 따른 취업규칙의 변경명령
11. Orders to change rules of employment under Article 96 (2) of the Act;
12. 법 제102조제3항에 따른 현장조사 또는 검진지령서의 발급
12. On-site inspections or issuance of orders for medical examination under Article 102 (3) of the Act;
13. 법 제104조제1항에 따른 위법사실 통보의 수리
13. Acceptance of notifications of violations under Article 104 (1) of the Act;
14. 법 제116조에 따른 과태료의 부과 및 징수
14. Imposition and collection of administrative fines under Article 116 of the Act;
15. 법률 제6974호 근로기준법중개정법률 부칙 제2조에 따른 특례 신고의 수리
15. Acceptance of reports on special cases under Article 2 of the Addenda to the Partial Amendment to the Labor Standards Act (Act No. 6974);
15의2. 제23조의7제1항에 따른 사업주의 임금등 체불자료 검토
15-2. Review of a business owner's data on unpaid wages, etc. under Article 23-7 (1);
16. 제28조제2항에 따른 임금보전방안의 제출명령 및 확인
16. Orders to submit, and confirmation of, measures to compensate for wages under Article 28 (2);
17. 제35조제2항에 따른 취직인허 신청의 접수
17. Receipt of applications for employment permission under Article 35 (2);
