동물보호법 제86조(출입ㆍ검사 등)

① 농림축산식품부장관, 시ㆍ도지사 또는 시장ㆍ군수ㆍ구청장은 동물의 보호 및 공중위생상의 위해 방지 등을 위하여 필요하면 동물의 소유자등에 대하여 다음 각 호의 조치를 할 수 있다.

② 농림축산식품부장관, 시ㆍ도지사 또는 시장ㆍ군수ㆍ구청장은 동물보호 등과 관련하여 필요하면 다음 각 호의 어느 하나에 해당하는 자에게 필요한 보고를 하도록 명하거나 자료를 제출하게 할 수 있으며, 관계 공무원으로 하여금 해당 시설 등에 출입하여 운영실태를 조사하게 하거나 관계 서류를 검사하게 할 수 있다.

③ 특별자치시장ㆍ특별자치도지사ㆍ시장ㆍ군수ㆍ구청장은 소속 공무원으로 하여금 제2항제2호에 따른 보호시설운영자에 대하여 제37조제4항에 따른 시설기준ㆍ운영기준 등의 사항 및 동물보호를 위한 시설정비 등의 사후관리와 관련한 사항을 1년에 1회 이상 정기적으로 점검하도록 하고, 필요한 경우 수시로 점검하게 할 수 있다.

④ 시ㆍ도지사와 시장ㆍ군수ㆍ구청장은 소속 공무원으로 하여금 제2항제7호에 따른 영업자에 대하여 다음 각 호의 구분에 따라 1년에 1회 이상 정기적으로 점검하도록 하고, 필요한 경우 수시로 점검하게 할 수 있다.

⑥ 농림축산식품부장관, 시ㆍ도지사 또는 시장ㆍ군수ㆍ구청장이 제1항제2호 및 제2항 각 호에 따른 출입ㆍ검사 또는 제3항 및 제4항에 따른 점검(이하 "출입ㆍ검사등"이라 한다)을 할 때에는 출입ㆍ검사등의 시작 7일 전까지 대상자에게 다음 각 호의 사항이 포함된 출입ㆍ검사등 계획을 통지하여야 한다. 다만, 출입ㆍ검사등 계획을 미리 통지할 경우 그 목적을 달성할 수 없다고 인정하는 경우에는 출입ㆍ검사등을 착수할 때에 통지할 수 있다.

⑦ 농림축산식품부장관, 시ㆍ도지사 또는 시장ㆍ군수ㆍ구청장은 제2항부터 제4항까지의 규정에 따른 출입ㆍ검사등의 결과에 따라 필요한 시정을 명하는 등의 조치를 할 수 있다.
