전기통신사업법 시행령 제65조(권한 등의 위임 및 위탁)
Enforcement Decree of the Telecommunications Business Act, Article 65 (Delegation and Entrustment of Authority, etc.)
① 과학기술정보통신부장관은 법 제93조제2항에 따라 다음 각 호의 권한을 중앙전파관리소장에게 위임한다. 다만, 회선설비 보유사업에 대해서는 제8호의2ㆍ제8호의3ㆍ제14호ㆍ제15호ㆍ제16호ㆍ제16호의2ㆍ제16호의3ㆍ제20호(법 제84조의2 위반에 대한 법 제92조제1항에 따른 시정명령으로 한정한다) 및 제22호(법 제104조제1항제6호 및 같은 조 제5항제15호에 따른 과태료의 부과 및 징수로 한정한다)의 권한으로 한정한다. <개정 2013.3.23, 2015.4.14, 2016.5.31, 2016.7.28, 2017.7.26, 2019.6.25, 2020.12.8, 2022.12.9, 2024.1.9, 2024.6.28, 2026.4.28>
(1) Under Article 93 (2) of the Act, the Minister of Science and ICT delegates the following authority to the Director of the Central Radio Management Office. However, for line facility-owning businesses, delegation is limited to the authority in subparagraphs 8-2, 8-3, 14, 15, 16, 16-2, 16-3, 20 (limited to corrective orders under Article 92 (1) of the Act for violations of Article 84-2 of the Act), and 22 (limited to the imposition and collection of administrative fines under Article 104 (1) 6 and paragraph (5) 15 of the same Article):
1. 법 제6조제1항에 따른 기간통신사업의 등록 및 신고의 접수ㆍ처리
1. Receipt and handling of registrations and reports of basic telecommunications business under Article 6 (1) of the Act;

7-2. Receipt and handling of reports of changes of value-added telecommunications business and registration of changes of special types of value-added telecommunications business under Article 23 of the Act;
7의3. 법 제24조에 따른 부가통신사업의 양도ㆍ양수 및 법인의 합병ㆍ상속신고의 접수ㆍ처리
7-3. Receipt and handling of reports of transfer and acquisition of a value-added telecommunications business and corporate mergers and inheritance under Article 24 of the Act;
7의4. 법 제26조에 따른 부가통신사업의 휴업ㆍ폐업신고 및 법인의 해산신고의 접수ㆍ처리
7-4. Receipt and handling of reports of suspension or closure of a value-added telecommunications business and reports of dissolution of a corporation under Article 26 of the Act;
8. 법 제27조제1항에 따른 부가통신사업의 폐업명령, 특수한 유형의 부가통신사업의 등록취소 및 사업의 정지명령
8. Orders to close a value-added telecommunications business, revocation of registration of special types of value-added telecommunications business, and orders to suspend business under Article 27 (1) of the Act;

19. 법 제90조제1항에 따른 과징금(법 제52조제5항에 따른 사업의 일부 정지를 갈음하여 부과하는 과징금은 제외한다)의 부과ㆍ징수 및 법 제91조에 따른 과징금의 납부기한 연장 및 분할납부 허용
19. Imposition and collection of penalty surcharges under Article 90 (1) of the Act (excluding penalty surcharges imposed in lieu of suspension of part of a business under Article 52 (5) of the Act) and extension of payment deadlines and permission of installment payment of penalty surcharges under Article 91 of the Act;
19의2. 법 제90조제2항에 따른 과징금(법 제65조제4항에 따른 자가전기통신설비 설치자에 대한 사용정지명령을 갈음하는 과징금에 한정한다)의 부과ㆍ징수
19-2. Imposition and collection of penalty surcharges under Article 90 (2) of the Act (limited to penalty surcharges in lieu of orders to suspend use against installers of private telecommunications facilities under Article 65 (4) of the Act);
20. 법 제92조제1항에 따른 시정명령
20. Corrective orders under Article 92 (1) of the Act;
21. 법 제92조제3항에 따른 전기통신역무 제공행위의 중지 및 전기통신설비의 철거 등의 조치 명령
21. Orders to cease the provision of telecommunications services and to take measures such as removing telecommunications facilities under Article 92 (3) of the Act;
22. 법 제104조에 따른 과태료의 부과 및 징수
22. Imposition and collection of administrative fines under Article 104 of the Act.
② 수사기관등은 법 제93조제3항에 따라 다음 각 호의 업무를 과학기술정보통신부장관에게 위탁한다. 다만, 제1호의 업무는 검사를 제외한 수사기관등만 해당한다. <신설 2024.6.28>
(2) Under Article 93 (3) of the Act, investigative agencies, etc. entrust the following work to the Minister of Science and ICT. However, the work in subparagraph 1 is limited to investigative agencies, etc. other than prosecutors:
1. 법 제83조의4제1항제1호ㆍ제4호 및 같은 조 제2항제1호에 따른 대행기관의 통지업무에 대한 관리ㆍ감독, 자료제출 요구, 실태 조사 및 시정 요구(전년도에 통신이용자정보 제공을 받은 사실의 통지 건수가 5만 건 이하인 경우만 해당한다)
1. Management and supervision of notice work of agency performers under Article 83-4 (1) 1 and 4 and paragraph (2) 1 of the same Article of the Act, requests for submission of data, fact-finding surveys, and requests for corrective action (limited to cases where the number of notices of the fact of having been provided with communications user information in the previous year was 50,000 or fewer);
2. 법 제83조의4제1항제2호ㆍ제3호 및 같은 조 제2항제2호에 따른 대행기관의 제도적ㆍ기술적 보안조치 등에 대한 관리ㆍ감독, 자료제출 요구, 실태 조사 및 시정 요구
2. Management and supervision of institutional and technical security measures and the like of agency performers under Article 83-4 (1) 2 and 3 and paragraph (2) 2 of the same Article of the Act, requests for submission of data, fact-finding surveys, and requests for corrective action.
③ 과학기술정보통신부장관은 법 제93조제4항에 따라 법 제32조의16제1항에 따른 안심거래 사업자 인증 업무 중 인증 신청 접수, 인증 심사 지원, 인증기준 유지 여부 점검, 인증 결과 통보 및 인증서 발급 업무를 한국정보통신진흥협회에 위탁한다. <신설 2026.4.28>
(3) Under Article 93 (4) of the Act, the Minister of Science and ICT entrusts to the Korea Information and Communications Promotion Association, among the work of certifying safe transaction business operators under Article 32-16 (1) of the Act, the receipt of certification applications, support for certification examinations, inspection of whether certification standards are maintained, notification of certification results, and issuance of certificates.
