Enforcement Decree of the Long-Term Care Insurance Act, Article 28-3 (Processing of Sensitive Information and Personally Identifiable Information)
국가(법 제64조에 따라 준용되는 「국민건강보험법」 제111조에 따라 보건복지부장관의 권한을 위임ㆍ위탁받은 자를 포함한다), 지방자치단체의 장(해당 권한이 위임ㆍ위탁된 경우에는 그 권한을 위임ㆍ위탁받은 자를 포함한다) 또는 공단(법 제64조에 따라 준용되는 「국민건강보험법」 제112조에 따라 공단의 업무를 위탁받은 자를 포함한다)은 다음 각 호의 사무를 수행하기 위하여 불가피한 경우 「개인정보 보호법」 제23조에 따른 건강에 관한 정보, 같은 법 시행령 제18조제2호에 따른 범죄경력자료에 해당하는 정보, 같은 영 제19조에 따른 주민등록번호 또는 외국인등록번호가 포함된 자료를 처리할 수 있다. 다만, 제15호의 사무의 경우에는 건강에 관한 정보 및 범죄경력자료에 해당하는 정보는 제외한다. <개정 2012.8.31, 2016.11.8, 2017.3.27, 2019.6.11, 2023.8.8>
Where unavoidable to carry out the following affairs, the State (including persons to whom the authority of the Minister of Health and Welfare has been delegated or entrusted under Article 111 of the National Health Insurance Act, as applied mutatis mutandis under Article 64 of the Act), the heads of local governments (including, where the relevant authority has been delegated or entrusted, persons to whom it has been delegated or entrusted), or the Service (including persons entrusted with the Service's work under Article 112 of the National Health Insurance Act, as applied mutatis mutandis under Article 64 of the Act) may process information concerning health under Article 23 of the Personal Information Protection Act, information that constitutes criminal history records under Article 18, subparagraph 2 of the Enforcement Decree of the same Act, and data containing resident registration numbers or alien registration numbers under Article 19 of the same Decree. However, for the affairs under subparagraph 15, information concerning health and information that constitutes criminal history records are excluded:
