Enforcement Decree of the Occupational Safety and Health Act, Article 115 (Delegation of Authority)
고용노동부장관은 법 제165조제1항에 따라 다음 각 호의 권한을 지방고용노동관서의 장에게 위임한다. <개정 2021.11.19, 2023.6.27, 2025.4.29>
Under Article 165 (1) of the Act, the Minister of Employment and Labor delegates the following authority to the heads of regional employment and labor offices:
1. 법 제10조제3항에 따른 자료 제출의 요청
1. Requests for submission of materials under Article 10 (3) of the Act;
2. 법 제17조제4항, 제18조제4항 또는 제19조제3항에 따른 안전관리자, 보건관리자 또는 안전보건관리담당자의 선임 명령 또는 교체 명령
2. Orders to appoint or replace safety officers, health officers, or safety and health officers in charge under Article 17 (4), 18 (4), or 19 (3) of the Act;
3. 법 제21조제1항 및 제4항에 따른 안전관리전문기관 또는 보건관리전문기관(이 영 제23조제1항에 따른 업종별ㆍ유해인자별 보건관리전문기관은 제외한다)의 지정, 지정 취소 및 업무정지 명령
3. Designation of specialized safety management institutions or specialized health management institutions (excluding specialized health management institutions by industry or by harmful factor under Article 23 (1) of this Decree), revocation of designation, and orders to suspend business under Article 21 (1) and (4) of the Act;
4. 법 제23조제1항에 따른 명예산업안전감독관의 위촉
4. Commissioning of honorary occupational safety inspectors under Article 23 (1) of the Act;
5. 법 제33조제1항 및 제4항에 따른 안전보건교육기관의 등록, 등록 취소 및 업무정지 명령
5. Registration of safety and health education institutions, revocation of registration, and orders to suspend business under Article 33 (1) and (4) of the Act;
6. 법 제42조제4항 후단에 따른 작업 또는 건설공사의 중지 및 유해위험방지계획의 변경 명령
6. Orders to stop work or construction work and to change hazard and risk prevention plans under the latter part of Article 42 (4) of the Act;
7. 법 제45조제1항 후단 및 제46조제4항ㆍ제5항에 따른 공정안전보고서의 변경 명령, 공정안전보고서의 이행 상태 평가 및 재제출 명령
7. Orders to change process safety reports, evaluation of the implementation status of process safety reports, and orders to resubmit them under the latter part of Article 45 (1) and Article 46 (4) and (5) of the Act;
8. 법 제47조제1항 및 제4항에 따른 안전보건진단 명령 및 안전보건진단 결과보고서의 접수
8. Orders to undergo safety and health diagnoses and receipt of reports on the results of safety and health diagnoses under Article 47 (1) and (4) of the Act;
9. 법 제48조제1항 및 제4항에 따른 안전보건진단기관의 지정, 지정 취소 및 업무정지 명령
9. Designation of safety and health diagnosis institutions, revocation of designation, and orders to suspend business under Article 48 (1) and (4) of the Act;
10. 법 제49조제1항에 따른 안전보건개선계획의 수립ㆍ시행 명령
10. Orders to establish and implement safety and health improvement plans under Article 49 (1) of the Act;
11. 법 제50조제1항 및 제2항에 따른 안전보건개선계획서의 접수, 심사, 그 결과의 통보 및 안전보건개선계획서의 보완 명령
11. Receipt and review of safety and health improvement plans, notification of the results, and orders to supplement safety and health improvement plans under Article 50 (1) and (2) of the Act;
12. 법 제53조제1항에 따른 시정조치 명령
12. Orders for corrective measures under Article 53 (1) of the Act;
13. 법 제53조제3항 및 제55조제1항ㆍ제2항에 따른 작업중지 명령
13. Orders to stop work under Article 53 (3) and Article 55 (1) and (2) of the Act;

14. Lifting of orders to stop use or to stop work under Article 53 (5) and Article 55 (3) of the Act;

15. Receipt and handling of business owners' reports of the occurrence of industrial accidents under Article 57 (3) of the Act;
16. 법 제58조제2항제2호, 같은 조 제5항ㆍ제6항ㆍ제7항에 따른 승인, 연장승인, 변경승인과 그 승인ㆍ연장승인ㆍ변경승인의 취소 및 법 제59조제1항에 따른 도급의 승인
16. Approvals, approvals of extension, and approvals of change under Article 58 (2) 2, (5), (6), and (7) of the Act, revocation of those approvals, approvals of extension, and approvals of change, and approval of contracting out under Article 59 (1) of the Act;
17. 법 제74조제1항 및 제4항에 따른 건설재해예방전문지도기관의 지정, 지정 취소 및 업무정지 명령
17. Designation of specialized guidance institutions for preventing construction accidents, revocation of designation, and orders to suspend business under Article 74 (1) and (4) of the Act;
18. 법 제82조제1항 및 제4항에 따른 타워크레인 설치ㆍ해체업의 등록, 등록 취소 및 업무정지 명령
18. Registration of tower crane installation and dismantling businesses, revocation of registration, and orders to suspend business under Article 82 (1) and (4) of the Act;
19. 법 제84조제6항에 따른 자료 제출 명령
