고용보험법 시행령 제145조의2(고유식별정보의 처리)
Enforcement Decree of the Employment Insurance Act, Article 145-2 (Processing of Unique Identifying Information)
① 고용노동부장관(제145조에 따라 고용노동부장관의 권한ㆍ업무를 위임ㆍ위탁받은 자를 포함한다)은 다음 각 호의 사무를 수행하기 위해 불가피한 경우 「개인정보 보호법 시행령」 제19조에 따른 주민등록번호 또는 외국인등록번호가 포함된 자료를 처리할 수 있다. <개정 2012.7.10, 2016.7.19, 2017.3.27, 2019.6.25, 2020.12.8, 2021.6.8, 2021.12.31, 2023.6.27, 2024.6.25>
(1) Where unavoidable to perform the following affairs, the Minister of Employment and Labor (including a person to whom the authority or affairs of the Minister of Employment and Labor have been delegated or entrusted under Article 145) may process data containing resident registration numbers or alien registration numbers under Article 19 of the Enforcement Decree of the Personal Information Protection Act:
1. 법 제10조제1항제3호 단서 및 이 영 제3조의2에 따른 별정직ㆍ임기제 공무원의 고용보험 가입 또는 탈퇴에 관한 사무
1. Affairs concerning the joining of, or withdrawal from, employment insurance by public officials in special service or fixed-term public officials under the proviso to Article 10 (1) 3 of the Act and Article 3-2 of this Decree;
1의2. 다음 각 목에 해당하는 사람의 고용보험 가입에 관한 사무
1-2. Affairs concerning the joining of employment insurance by the following persons:
가. 법 제10조의2제1항에 따른 외국인근로자
(a) Foreign workers under Article 10-2 (1) of the Act;
나. 법 제10조의2제2항 및 이 영 제3조의3에 따른 근로계약 체결 외국인, 외국인예술인 및 외국인노무제공자
(b) Foreigners who have entered into labor contracts, foreign artists and foreign labor providers under Article 10-2 (2) of the Act and Article 3-3 of this Decree;
다. 법 제10조제1항제5호 및 이 영 제3조제3항제2호 단서에 따른 근로자의 고용보험 가입 또는 탈퇴에 관한 사무
(c) Affairs concerning the joining of, or withdrawal from, employment insurance by workers under Article 10 (1) 5 of the Act and the proviso to Article 3 (3) 2 of this Decree;
2. 법 제15조에 따른 피보험자격의 취득ㆍ상실 등의 신고에 관한 사무
2. Affairs concerning reports on the acquisition, loss, etc. of insured status under Article 15 of the Act;

4. 법 제17조에 따른 피보험자격의 확인에 관한 사무
4. Affairs concerning the confirmation of insured status under Article 17 of the Act;

5. Affairs concerning support for business owners who expand employment opportunities under Article 20 of the Act;
6. 법 제21조에 따른 고용안정을 위한 조치를 한 사업주에 대한 지원에 관한 사무
6. Affairs concerning support for business owners who have taken measures for employment security under Article 21 of the Act;
7. 법 제22조에 따른 지역 고용촉진 사업주에 대한 지원에 관한 사무
7. Affairs concerning support for business owners promoting regional employment under Article 22 of the Act;
8. 법 제23조에 따른 고령자등 고용촉진의 지원에 관한 사무
8. Affairs concerning support for promoting the employment of older persons, etc. under Article 23 of the Act;
9. 법 제25조에 따른 고용안정 및 취업촉진 사업을 실시하는 자에 대한 지원 및 대부에 관한 사무

11. Affairs concerning support for the costs of vocational skills development training for business owners under Article 27 of the Act;

12. Affairs concerning support, etc. for the vocational skills development of insured persons, etc. under Article 29 of the Act;
13. 법 제30조에 따른 직업능력개발 훈련 시설의 설치, 장비구입 비용 등의 대부ㆍ지원에 관한 사무
13. Affairs concerning loans and support for the costs of installing vocational skills development training facilities, purchasing equipment, etc. under Article 30 of the Act;
14. 법 제31조에 따른 직업능력개발의 촉진 사업을 실시하는 자에 대한 지원에 관한 사무
14. Affairs concerning support for persons carrying out programs to promote vocational skills development under Article 31 of the Act;
15. 법 제35조에 따른 부정행위를 이유로 한 지원금의 반환명령 또는 추가징수에 관한 사무
15. Affairs concerning orders to return subsidies, or additional collection, on account of fraudulent acts under Article 35 of the Act;
15의2. 법 제55조의2에 따른 국민연금 보험료의 지원에 관한 사무
15-2. Affairs concerning support for national pension insurance premiums under Article 55-2 of the Act;
16. 법 제70조에 따른 육아휴직 급여의 지급에 관한 사무
16. Affairs concerning the payment of childcare leave benefits under Article 70 of the Act;
17. 법 제73조의2에 따른 육아기 근로시간 단축 급여의 지급에 관한 사무
17. Affairs concerning the payment of benefits for reduced working hours during the childcare period under Article 73-2 of the Act;
18. 법 제75조에 따른 출산전후휴가 급여등 및 법 제76조의2에 따른 출산전후휴가 급여등에 상당하는 금액의 지급에 관한 사무
18. Affairs concerning the payment of maternity leave benefits, etc. under Article 75 of the Act and of an amount equivalent to maternity leave benefits, etc. under Article 76-2 of the Act;
19. 법 제75조의2에 따른 출산전후휴가 급여등의 대위 신청에 관한 사무
19. Affairs concerning applications for subrogation of maternity leave benefits, etc. under Article 75-2 of the Act;
19의2. 법 제77조의2 및 제77조의5제1항에 따른 예술인인 피보험자의 피보험자격 신고에 관한 사무
19-2. Affairs concerning reports on the insured status of insured artists under Article 77-2 and Article 77-5 (1) of the Act;
19의3. 법 제77조의6, 제77조의7 및 제77조의10제1항에 따른 노무제공자인 피보험자의 피보험자격 신고에 관한 사무
19-3. Affairs concerning reports on the insured status of insured labor providers under Articles 77-6 and 77-7 and Article 77-10 (1) of the Act;
20. 법 제108조에 따른 보고 등의 요구에 관한 사무
20. Affairs concerning requirements to report, etc. under Article 108 of the Act;
21. 법 제109조에 따른 조사 등에 관한 사무
21. Affairs concerning investigations, etc. under Article 109 of the Act;
22. 법 제110조에 따른 자료 제출의 요청에 관한 사무

23. 법 제112조에 따른 부정행위의 신고 및 신고포상금의 지급에 관한 사무
23. Affairs concerning reports of fraudulent acts and payment of rewards for reporting under Article 112 of the Act;
24. 제4조에 따른 대리인 선임 또는 해임 신고에 관한 사무
24. Affairs concerning reports on the appointment or dismissal of agents under Article 4;
25. 제10조, 제104조의7 및 제104조의14에 따른 피보험자 이름 등의 변경 신고에 관한 사무
25. Affairs concerning reports of changes in the names, etc. of insured persons under Articles 10, 104-7 and 104-14.
② 직업안정기관의 장은 다음 각 호의 사무를 수행하기 위해 불가피한 경우 「개인정보 보호법 시행령」 제19조제1호 또는 제4호에 따른 주민등록번호 또는 외국인등록번호가 포함된 자료를 처리할 수 있다. <개정 2020.8.27, 2020.12.8, 2021.6.8>
(2) Where unavoidable to perform the following affairs, the head of an employment security office may process data containing resident registration numbers or alien registration numbers under Article 19, subparagraph 1 or 4 of the Enforcement Decree of the Personal Information Protection Act:
1. 법 제62조ㆍ제74조ㆍ제77조에 따른 부정행위를 이유로 한 구직급여 등의 반환명령 및 추가징수에 관한 사무
1. Affairs concerning orders to return job-seeking benefits, etc., and additional collection, on account of fraudulent acts under Articles 62, 74 and 77 of the Act;
2. 법 제42조에 따른 실업의 신고(이직확인서의 확인에 관한 사무를 포함한다)에 관한 사무
2. Affairs concerning reports of unemployment under Article 42 of the Act (including affairs concerning the verification of certificates of leaving employment);
3. 법 제43조에 따른 수급자격의 인정에 관한 사무
3. Affairs concerning the recognition of eligibility under Article 43 of the Act;
4. 법 제44조에 따른 실업의 인정 등에 관한 사무
4. Affairs concerning the recognition of unemployment, etc. under Article 44 of the Act;
5. 법 제48조 및 이 영 제71조에 따른 수급기간의 연기 등에 관한 사무
5. Affairs concerning the postponement, etc. of the benefit period under Article 48 of the Act and Article 71 of this Decree;
6. 법 제52조에 따른 개별연장급여의 지급에 관한 사무
6. Affairs concerning the payment of individual extended benefits under Article 52 of the Act;
7. 법 제57조에 따른 미지급 구직급여의 지급에 관한 사무
7. Affairs concerning the payment of unpaid job-seeking benefits under Article 57 of the Act;
8. 법 제63조에 따른 상병급여의 지급에 관한 사무
8. Affairs concerning the payment of sickness benefits under Article 63 of the Act;
9. 법 제64조에 따른 조기재취업 수당의 지급에 관한 사무
9. Affairs concerning the payment of the early re-employment allowance under Article 64 of the Act;
10. 법 제66조에 따른 광역 구직활동비의 지급에 관한 사무
10. Affairs concerning the payment of wide-area job-seeking expenses under Article 66 of the Act;
11. 법 제67조에 따른 이주비의 지급에 관한 사무
11. Affairs concerning the payment of relocation expenses under Article 67 of the Act;
12. 법 제77조의3, 제77조의4 및 제77조의5제2항ㆍ제3항에 따른 구직급여와 출산전후급여등의 지급에 관한 사무
12. Affairs concerning the payment of job-seeking benefits and childbirth benefits, etc. under Articles 77-3 and 77-4 and Article 77-5 (2) and (3) of the Act;
13. 법 제77조의8, 제77조의9 및 제77조의10제2항ㆍ제3항에 따른 구직급여와 출산전후급여등의 지급에 관한 사무
13. Affairs concerning the payment of job-seeking benefits and childbirth benefits, etc. under Articles 77-8 and 77-9 and Article 77-10 (2) and (3) of the Act.
③ 심사관은 법 제87조제1항에 따른 심사청구에 관한 사무를 수행하기 위하여 불가피한 경우 「개인정보 보호법 시행령」 제19조제1호 또는 제4호에 따른 주민등록번호 또는 외국인등록번호가 포함된 자료를 처리할 수 있다.
(3) Where unavoidable to perform affairs concerning requests for review under Article 87 (1) of the Act, an examiner may process data containing resident registration numbers or alien registration numbers under Article 19, subparagraph 1 or 4 of the Enforcement Decree of the Personal Information Protection Act.
④ 심사위원회는 다음 각 호의 사무를 수행하기 위하여 불가피한 경우 「개인정보 보호법 시행령」 제19조제1호 또는 제4호에 따른 주민등록번호 또는 외국인등록번호가 포함된 자료를 처리할 수 있다.
(4) Where unavoidable to perform the following affairs, the Review Committee may process data containing resident registration numbers or alien registration numbers under Article 19, subparagraph 1 or 4 of the Enforcement Decree of the Personal Information Protection Act:
1. 법 제87조제1항에 따른 재심사 청구에 관한 사무
1. Affairs concerning requests for re-review under Article 87 (1) of the Act;
2. 법 제101조제5항ㆍ제6항에 따른 심리조서 열람에 관한 사무
2. Affairs concerning the inspection of records of hearings under Article 101 (5) and (6) of the Act.
